Black Swan Ventures Accommodations Agreement

This Rental Agreement ("Agreement") is entered into between you (referred to as "Guest" or "You") and Black Swan Ventures LLC ("Black Swan Ventures", "We", "Us", or "Our"), collectively referred to as the "Parties", for the purpose of renting fully furnished accommodations ("Unit" or "Property") offered by Black Swan Ventures under the terms and conditions outlined below. By making a reservation, renting a Unit, or using/accessing the services provided by Black Swan Ventures, you acknowledge that you have read, understood, and agreed to abide by the terms of this Agreement.

1. Eligibility: To make a reservation, rent a Unit, or access and use our services, you must be at least 18 years of age. By proceeding with a reservation, rental, or use of services, you confirm that you meet these eligibility requirements, are authorized to enter into this Agreement, and agree to comply with all applicable laws and regulations.

2. Privacy: Your privacy is important to us. We may collect and process your information in accordance with our Privacy Policy. By making a reservation, renting a Unit, or using our services, you consent to collecting, using, and disclosing your information as outlined in the Privacy Policy.

3. Modification of Terms: We reserve the right to modify, amend, or update the terms of this Agreement at any time. Changes will be effective upon posting, and your continued use of our services constitutes your acceptance of the modified terms. It is your responsibility to review this Agreement periodically for updates.

4. License Grant and Unauthorized Use: Subject to your compliance with the terms of this Agreement, we grant you a limited, non-exclusive, non-transferable license to access and use our services. Unauthorized use or violation of these terms may result in termination of this Agreement and denial of access to our services.

5. Units:
a. Guests are responsible for reading and understanding these terms, property rules, and any additional policies provided.
b. You shall maintain the Unit in good and clean condition, using it lawfully and carefully.
c. Smoking is strictly prohibited inside the Unit or anywhere on the Property, including balconies.
d. You agree to be a good neighbor, respecting the rights of surrounding occupants to a peaceful environment.
e. Events or parties in the Unit or on the Property are strictly prohibited.
f. Any unlawful activity in the Unit is grounds for immediate termination of this Agreement.
g. The Unit and Property shall not be used for residence or household purposes.

6. Pets and Additional Guests:
a. Pets are allowed with prior permission and subject to applicable fees.
b. Maximum occupancy limits apply to the Unit. Additional guests are only allowed with our express consent.

7. Additional Services: Complimentary TV and WiFi services are provided. We are not liable for service disruptions.

8. Access and Inspection: We reserve the right to access the Unit for cleaning, maintenance, repairs, and inspections. We will make reasonable efforts to notify you in advance.

9. Fees and Payments:
a. Unit Fees, as well as other fees (e.g., pet fees, parking fees, cleaning fees), are outlined in our Fee Schedule.
b. All payments must be made in advance by credit or debit card through our designated payment processor.

10. Modifications to Units: We may modify or discontinue renting certain Units without prior notice.

11. Cancellation Policy: Cancellation policies are based on the booking platform used. Please refer to the relevant platform for cancellation terms.

12. Guest Screening Policy: We conduct guest screening checks and may cancel reservations based on screening results.

13. Support: Technical and other support is available during specified hours.

14. Additional Policies: By making a reservation, renting a Unit, or using our services, you agree to adhere to any additional posted policies, guidelines, or rules applicable to the Units and services.

15. Reservation Information: You agree to provide accurate and complete reservation information and promptly update it as necessary.

16. Text Messages; Mobile and Data Charges: You may receive text message offers and alerts from us. You are responsible for any mobile and data charges incurred.

17. Indemnification: You agree to indemnify, defend, and hold harmless Black Swan Ventures from any damages, claims, costs, or liabilities arising from this Agreement or your actions, excluding situations caused by our negligence or willful acts.

18. Waiver: Our waiver of any breach by you of this Agreement shall not constitute a waiver of any subsequent breach.

19. Right of Entry: We have the right to enter the Rental Unit if necessary.

20. Terms: Various terms, including interpretation, severability, force majeure, entire agreement, governing law, venue, and attorneys' fees, apply to this Agreement.

21. Fee Schedule: Refer to our Fee Schedule for detailed information on fees associated with various issues.

By clicking "I AGREE," making a reservation, renting a Unit, or using our services, you acknowledge and agree to all terms and conditions outlined in this Agreement. If you do not agree to these terms, please do not proceed with a reservation, rental, or use of our services.

Fee Schedule:

Issue Fee (all charges in $USD, unless otherwise noted)

Unauthorized Late Check Out $50 charge plus $25 for each additional hour

Smoking in Room/Common Area $250.00 minimum charge and eviction from Rental Unit

Excessive Cleaning Up to $125.00 per hour of additional cleaning needed

Damaged or Missing Items Varies depending on cost of item

Missing Keys $50.00 minimum charge

Missing Fob $150.00 minimum charge

Missing Parking Pass/Garage Remote $100.00 minimum charge

Unauthorized Pets $250.00 plus any damages or additional cleaning costs incurred

Noise Complaints Complaint: potential warning issued or, if necessary, eviction with no refund and a charge of up to $1,000.00

Party in Unit or Common Area Up to $2,000.00 plus any damages to Black Swan Ventures

Forgotten Personal Belongings $75.00 minimum charge
